The terms, in plain terms.
These Terms of Service are the agreement between you and KindlingLearn when you create an account or use the service. They are written to be read: what the service is and is not, what you can expect from us, and what we ask of you. The privacy side of things is on the Privacy page.
Accepting these terms
By creating an account or using KindlingLearn ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
Who may use KindlingLearn
KindlingLearn is designed and intended exclusively for adult end-users, including parents, legal guardians, and educators. By registering, you represent that you are at least 18 years old and that any information you enter about a learner is provided by you as an adult — learners do not register, hold accounts, or submit information themselves.
What KindlingLearn is — and is not
KindlingLearn is an educational-support tool and is not a clinical, medical, or diagnostic service. KindlingLearn does not perform autism or any other clinical diagnosis, does not render medical advice, and its outputs are not a substitute for professional medical guidance or official school-administered Individualized Education Program (IEP) or Section 504 Plan documents. No doctor-patient, therapist-client, or special-education professional relationship is created by your use of this service. Do not disregard or delay seeking advice from qualified healthcare or special-education professionals based on information from KindlingLearn.
Any plan, export, or report generated by the Service is reference material for adults and is not an official IEP/504 document. Final decisions about a learner's educational program rest with the qualified professionals and school teams responsible for that learner.
Children's privacy (COPPA)
KindlingLearn is not directed at children under the age of 13, and we do not knowingly collect personal information directly from children. If we become aware that we have received personal information from a child, we will take commercially reasonable measures to delete such information without delay. Information about learners is entered by adults, and remains under the account holder's control at all times.
Your account and your data
- You are responsible for the accuracy of the information you enter and for keeping your sign-in credentials confidential.
- You may correct or delete learner profile information at any time, and you may delete your account and all associated data self-serve at /delete-account. Deletion is immediate and irreversible.
- For product development and testing purposes, only synthetic, non-identifiable data was utilized; no real-world children's personal data was used in development.
Acceptable use
You agree not to misuse the Service: no attempts to access other users' data, no automated scraping, no interference with the Service's operation, and no use of the Service for any purpose other than supporting a learner's education.
Intellectual property
The Service's software, design, and original content are the property of KindlingLearn. Your data remains yours; you grant us only the rights needed to operate the Service (store, process, and display it back to you).
Limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, KindlingLearn is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including decisions made about a learner's education.
Service availability
The Service is offered free of charge. We may update, suspend, or discontinue the Service (or any part of it) at any time. If we decide to discontinue the Service, we will aim to give you a reasonable opportunity to export your data before it is turned off.
Changes to these terms
We may update these Terms as the Service evolves. Material changes will be announced on this page with a new "Last updated" date; continued use after changes take effect constitutes acceptance.
Governing law and venue
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought in the state or federal courts located in Arkansas.
